These Terms of Service (“Terms”) govern your access to and use of the website telosagility.com, its assessment tools, and any coaching or advisory services provided by Telos Agility LLC (“Telos Agility,” “we,” “us,” or “our”), a Florida limited liability company. By accessing this website, using any of our assessment tools, or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our website or services.
1. Description of Services
Telos Agility provides the following:
(a) Assessment Tools. The Leadership Consciousness Index (LCI), Strategy Execution Index (SEI), and SPM Portfolio Diagnostic (collectively, “Assessment Tools”) are self-reflection and thinking tools designed to facilitate leadership awareness. They are currently offered in early alpha. They are NOT validated psychometric instruments, clinical assessments, or diagnostic tools of any kind. Results are intended solely as frameworks for reflection and conversation, not as definitive measurements of any psychological, clinical, or organizational characteristic.
(b) Executive Coaching Services. Coaching engagements are professional advisory relationships governed by a separate coaching agreement executed prior to commencement of services. Coaching is not therapy, counseling, psychotherapy, mental health treatment, or medical advice. Coaching does not diagnose or treat any mental, emotional, or physical health condition. Nothing provided through Telos Agility constitutes legal, financial, or medical advice.
(c) Advisory and Consulting Services. Strategy-to-execution advisory, scaled agile implementation, and related professional services are governed by separate engagement agreements.
2. Early Alpha Status of Assessment Tools
The Assessment Tools are currently provided in early alpha. This means:
- The tools have not undergone independent psychometric validation.
- Scoring algorithms, level descriptions, and interpretive frameworks are subject to change without notice.
- Results should not be relied upon for employment decisions, clinical diagnosis, or any purpose requiring a validated psychometric instrument.
- By using an Assessment Tool, you acknowledge its early alpha status and accept results as a starting point for reflection, not a definitive assessment.
- Consent Verification. When you accept these Terms before using a diagnostic tool, we log your acceptance together with a timestamp, your IP address, and a unique session identifier. That identifier is used solely to verify that the person who accepted these Terms is the same person who submitted the corresponding diagnostic results, and is not used for any other tracking or marketing purpose.
3. No Guaranteed Outcomes
You acknowledge and agree that:
- No specific business, financial, leadership, or personal outcome is guaranteed as a result of using any Assessment Tool or engaging Telos Agility coaching or advisory services.
- Client experiences and outcomes described on this website represent individual experiences. They are illustrations to aid understanding, not guarantees or representations of what you will experience. They are not indicative of typical results.
- You are solely responsible for your own decisions, actions, and outcomes. Telos Agility provides information, frameworks, and coaching support; the application of any insights is your responsibility alone.
- Individual results depend on many factors outside Telos Agility’s control, including but not limited to your individual effort, organizational context, team dynamics, and market conditions.
4. Confidentiality
Telos Agility treats information shared in coaching and advisory engagements as confidential. The following limitations apply:
- Confidentiality does not apply where disclosure is required by law, court order, or applicable professional or ethical standards.
- If Peter Jessen, as your coach or advisor, has reasonable belief that you or another person is at imminent risk of serious harm, confidentiality may be limited to the extent necessary to address that risk.
- Assessment Tool results submitted through our forms are stored and processed in accordance with our Privacy Policy. Results may be used by Peter Jessen in preparing for coaching or advisory sessions.
- If a third party (such as an employer) is sponsoring your coaching engagement, the terms of what information will and will not be shared with that sponsor will be specified in a separate coaching agreement and disclosed to you before the engagement begins.
5. Professional Standards
Peter Jessen holds the Professional Certified Coach (PCC) credential from the International Coach Federation (ICF) and is bound by the ICF Code of Ethics. Coaching services provided through Telos Agility are conducted in accordance with ICF professional standards, including obligations regarding scope of practice, confidentiality, conflicts of interest, and competence. A copy of the ICF Code of Ethics is available at coachingfederation.org.
6. Fees, Cancellation, and Refunds
Specific payment terms, package structures, and refund policies for coaching and advisory engagements are set forth in the individual coaching or advisory agreement executed prior to commencement of services, which governs in the event of any conflict with these Terms.
As a general policy applicable to all engagements:
- Telos Agility’s delivery obligation is fulfilled by making sessions or advisory time available at scheduled times with reasonable notice. Client non-attendance, failure to schedule, or failure to complete between-session work does not constitute non-delivery by Telos Agility.
- If Client terminates a coaching or advisory engagement for any reason, fees paid are nonrefundable. Client’s commitment to the engagement is the basis on which Telos Agility arranges its schedule, declines other engagements, and allocates resources.
- If Telos Agility terminates a coaching or advisory engagement prior to completion, Client shall receive a pro-rated refund calculated as: (sessions not yet made available ÷ total contracted sessions) × total Engagement Fee. This pro-rated refund is the Client’s sole remedy in the event of Telos Agility’s early termination.
- If Client fails to schedule or attend any session for sixty (60) consecutive days despite at least two written outreach attempts by Telos Agility, Telos Agility may declare the engagement complete and retain all fees as earned.
- To the extent any applicable federal or state law provides a right of cancellation for the specific transaction, that right applies only to sessions or services not yet made available as of the date written notice is received by Telos Agility. Written cancellation notice must be sent to peter.jessen@telosagility.com.
7. Intellectual Property and DMCA
All content on this website, including but not limited to the LCI, SEI, and SPM Portfolio Diagnostic assessment questions, scoring algorithms, level descriptions, frameworks, articles, and course materials, is the proprietary intellectual property of Telos Agility LLC and is protected by United States copyright law. Unauthorized reproduction, distribution, or use of any proprietary content without prior written permission is prohibited.
You may use Assessment Tool results for your own personal and professional development. You may not reproduce, distribute, resell, or create derivative works from any Assessment Tool content without prior written permission from Telos Agility.

9. Disclaimer of Warranties
THIS WEBSITE AND ALL ASSESSMENT TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TELOS AGILITY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TELOS AGILITY DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TELOS AGILITY LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE, ASSESSMENT TOOLS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL TELOS AGILITY’S TOTAL LIABILITY TO YOU EXCEED THE FEES PAID BY YOU TO TELOS AGILITY IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Dispute Resolution and Class Action Waiver
Any dispute arising out of or relating to these Terms or your use of the website or services shall first be submitted to good-faith negotiation between the parties. If negotiation fails within thirty (30) days, the dispute shall be resolved by binding arbitration in Pasco County, Florida, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.
YOU AGREE TO RESOLVE DISPUTES WITH TELOS AGILITY ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST TELOS AGILITY. THIS WAIVER APPLIES TO ALL CLAIMS, WHETHER ARISING BEFORE OR AFTER THE EFFECTIVE DATE OF THESE TERMS.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law provisions. To the extent any dispute is not subject to arbitration under Section 11, you consent to the exclusive jurisdiction of the state and federal courts located in Pasco County, Florida.
13. Changes to These Terms
Telos Agility reserves the right to update these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the website or services after the effective date constitutes acceptance of the updated Terms. Material changes will be communicated by email to active clients.
